1) All details provided to Locums Direct to be true and accurate.
2) To maintain appropriate clinical standards and act in a professional manner at all times.
3) Not to undermine the reputation of the store/employer (Locums Direct clients).
4) Must be registered with the General Optical Council (GOC) and appropriate Primary Care Trust and/or Health Board and have a valid Supplementary Ophthalmic List Number providing entitlement to carry out tests on NHS patients.
5) To work in accordance with statutory and regulatory requirements of the GOC code of Conduct and all Acts relating to Opticians in force.
6) Must maintain an up-to-date record of their Continuing Profession Development (CPD) in line with GOC guidelines and supply details to Locums Direct when requested.
7) Must inform the GOC and employers of any declaration over their fitness to be registered/practice and must not practice if restrictions have been applied.
8) Must have adequate professional Liability/Indemnity Insurance and ensure that appropriate cover is maintained. The payment of premiums being the responsibility of the locum.
9) Must be a permanent UK resident or be eligible to work in the UK by being compliant with the regulations under the Asylum & Immigration Act (1996) and any other relative regulations. In the case that the locum is a foreign national, they must have no entries on their passport indicating any restrictions on being allowed to work in the UK.
10) Upon request, the locum will provide Locums Direct with copies of all relevant documents necessary to assist Locum Direct in complying with UK agency regulations, UK law and client contractual requirements.
11) There is no entitlement to paid annual leave, as a locum is self-employed and responsible for the payment of their own Tax and National Insurance payments. The locum needs to be in compliance of HMRC and any challenge of status will not affect Locums Direct or the store/employer.
12) As a locum, you are not an employee of Locums Direct or any companies connected or relating to them and hence have no authority to act for and on behalf of Locums Direct.
13) The locum acknowledges that the nature of temporary work means that there may be periods when no suitable work is available and agrees that Locums Direct shall incur no liability to the locum should it fail to offer opportunities to work.
14) Agree not to pass details of internal matters (including booking / booking request data) into the public domain.
15) Agree to notify the store/employer via the Locums Direct App as soon as possible should you not be able to fulfil or attend any agreed bookings.
16) In the event a store/employer cancels an agreed booking, Locums Direct will not be held responsible or liable for any loss in earnings incurred to the locum.
17) Locums Direct shall not be liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) which may be suffered or incurred by the locum arising from or in any way connected with Locums Direct.
18) In cases where the store/employer has reason to seek compensation due to a locum’s non-appearance for an agreed booking, the responsibility for meeting the compensation rests solely with the respective locum and not Locums Direct.
19) Locums Direct has no responsibility for payment or collection of any payments due to the locum from a store/employer.
20) Locums Direct will never be responsible for the payment of a locum’s fees and/or expenses, whatever the circumstances leading to non-payment – including booking error.
21) Locum is not permitted to accept any direct bookings with any Locums Direct clients (stores/employers). If a locum wishes to take direct bookings they must inform Locums Direct, in order for Locums Direct to obtain any charges/fees owed to Locums Direct by its clients (stores/employers) as a result.
22) Locums Direct is a platform for connecting locums with employers and therefore takes no responsibilities should either the locum or employer provide misleading information.
